GENERAL

The equipment on hire shall always remain the full legal & absolute property of Infinity Digipix (hereinafter referred to as 'The Company').

The Hirer has no authority to assign, sell or re-hire the equipment without the express permission of The Company.

The Hirer is fully responsible for the safe keeping and safe operation of all hired equipment and shall take all reasonable care to ensure it is not lost, stolen, damaged or mis-used in any way during the period of hire.

The company does not warrant or guarantee the equipment, nor any media held therein but takes all care to ensure it is fully serviceable on delivery and capable to function as expected during the hire period. A handover process is conducted with the Hirer or their representative to ensure that all equipment is serviceable on receipt.

BOOKING & SECURITY DEPOSIT (BSD)

The Hirer will be required to leave a deposit (BSD) on confirmation of the booking. This deposit is fully refunded on return of all equipment to The Company in serviceable condition. Specific situations that would cause non-refund of the BSD are detailed below.

CANCELLATION POLICY

If the booking is cancelled before the hire commences, the Hirer shall forfeit their BSD. If cancellation is made more than 7-days before the scheduled start of hire, no further charges will be made. If cancellation is made less than 7-days, but more than 2-days before the scheduled start of hire, 50% of the hire fee is due to The Company and shall be invoiced to the hirer. If cancellation is made less than 2-days before the scheduled start of hire, the full hire fee is due and shall be invooiced to the Hirer. Any invoices arising from cancellation of bookings are to be settled in full within 28 days of the invoice date.

LATE RETURNS

Failure to return the hired equipment on the agreed time/date will incur a charge of two-times the daily rate for every day and part-day in excess of the hire agreement in addition to the Hirer's forfeit of the BSD. Charges for late returns shall be invoiced to the Hirer and are to be settled within 28-days of the invoice date.

EXTENDING THE HIRE PERIOD

The standard hire period of 3-days may be extended by mutual agreement between the Hirer and The Company and will incur a daily rate up to but not exceeding two-times the standard daily hire rate, dependant on the notice period. Rates for extended hire shall be at The Company's discretion on a case-by-case basis.

INDEMNITY

The Hirer shall at all times fully indemnify the Company against all actions, costs, claims, legal proceedings & liability from the associated use of the hired equipment. The Company will accept no responsibility for any legal action on behalf of the Hirer's use of the hired equipment.

PAYMENT

The hired equipment will only be handed over to the Hirer on fully cleared receipt of all funds due. Payment by cheque should be made at least 14 days prior to the scheduled delivery date to allow for clearance of funds; cheques will not be accepted on the day of delivery. Electronic payment can be made via Paypal by mutual agreement; all electronic invoices must be settled in full and funds cleared prior to delivery.

IMAGE OWNERSHIP

All images (still and video) taken are fully owned by the Hirer and no backups shall be held by The Company for the purposes of recovery in the event of discs becoming lost or damaged. The company shall not be held responsible for the retention of any images beyond the hire period; the Hirer is advised to download all media (images and video clips) captured during the hire period in cases where such media may be considered by the Hirer to be of significant personal value. The Hirer may request that images be held by The Company for an agreed period as negotiated by both the Hirer and The Company on a case-by-case basis. The Company may retain specific images for marketing purposes only; any such retention shall be by mutual agreement between The Company and the Hirer.

ACCIDENTAL DAMAGE

The Hirer is responsible for all equipment during the hire period. The Hirer may specify a representative to act as equipment custodian durng the hire period; in this case the Hirer remains responsible and The Company does not enter into any contract with the Hirer's representative. Any damage to the hired equipment will result in the loss of the BSD. Where damage renders the equipment unserviceable, the Hirer shall be required to cover the cost of repair or replacement where such cost exceeds the amount of the BSD. Inspection will be conducted during the equipment delivery and handover process, during which serviceability states shall be agreed with the Hirer or their representative in order to protect both the Hirer and The Company; the inspection documentation shall be signed by the Hirer or representative and The Company. Any costs exceeding the amount of the BSD in repsect of repair or replacement of damaged equipment shall be invoiced to the Hirer separately. The Company may only charge the Hirer for damage agreed during the handover process. The Hirer may waive the handover process. In this case a signature is required and The Company reserves the right to inspect the equipment in the absence of the Hirer and take appropriate recovery action for damaged equipment as detailed above. All invoices raised are to be settled within 28 days of the invoice.

LOSS OR THEFT

The Hirer is fully responsible for all equipment hired during the period from delivery to collection by The Company & will be charged for any item not present at the time of collection. The standard charges are £60 per camera, £2 per battery, £6 per memory card and £40 per carrying case. The BSD will not be refunded in any case of equipment loss or theft and will not be held in part payment for lost or stolen items at the rates detailed herein. Any charges arising from loss or theft shall be invoiced to the Hirer and are to be settled within 28-days of the invoice.

DELIVERY BY COURIER

Where courier delivery is agreed, The Company shall remain responsible for all hired equipment until received by the hirer. The company shall ensure that all equipment is checked and serviceable prior to dispatch and include within the package a dispatch record detailing any acceptable damage to the equipment, such as minor scratches etc. The Hirer is required to notify the Company via e-mail of satisfactory receipt within 24 hours of delivery by the courier, including details of any damage in excess of that detailed within the dispatch record. This notification serves as the Hirer's acceptance of responsibility for the equipment.

RETURN BY COURIER

Where courier return is agreed, The Hirer is responsible for the return of the equipment, including the selection of and payment for courier services, within the agreed time and shall remain responsible for all hired equipment from their acceptance of responsibility until its receipt by the Company. On receipt from the courier, the Company shall ensure that all equipment is present, serviceable and free of damage in excess of that detailed on the dispatch record and indicated by the Hirer on acceptance of responsibility. The Company shall notify the Hirer via e-mail of satisfactory receipt within 24 hours of delivery by the courier, including details of any discrepancies or damage not detailed within the dispatch record. This notification serves as the Company's acceptance of responsibility for the equipment. Any missing or damaged equipment detailed on the Company's acceptance of responsibility shall be subject to the terms detailed in the 'LOSS OR THEFT' and 'ACCIDENTAL DAMAGE' sections. Where the equipment is returned after the agreed date, the 'LATE RETURNS' section shall apply.

There are no exceptions to this policy.
